2. "A stranger to contract cannot sue". Comment. (Marks
At the time of partition of a family, male members of the family agreed to bear the expense of marriage of a female member. She was not party to the agreement. Can she enforce the agreement? Give reasons for your answer. (Marks
3. "Damages are compensatory not penal". Discuss. (Marks
lends Rs. 1000 to on the condition that he will repay the amount in 5 EMI and on default of payment of an EMI, whole of the amount will become recoverable. Discuss whether the above contract is penal and can be enforced? (Marks
4. "The word impossibility has not been used under Section 56 in the sense of mere physical impossibility." Explain. (Marks
