Law of Contract-II

Note: Answer any TWO questions out of three.

1. Answer the following:
a. Ram hired a wooden shop under a written agreement that the shop will be returned in the same condition to the owner Shyam and the hirer will be liable for any loss or damage to it. The shop was burnt by the mob during the communal riots in the city. Discuss the liability of Ram? (Marks 05)
b. is the servant of and was in the possession of certain goods of While was temporarily absent, pledged the goods. Whether pledge of the goods by will be a valid pledge? Explain with the help of relevant provisions and case laws.

2. Answer the following:
a. Distinguish 'Guarantee' from 'Indemnity'. Quote the applicable provisions of law and case laws to 'illustrate' your answer. (Marks 05)
b. Ananya wanted to attend a function and for safety concerns left her car in her close friend Saloni's premises and handed over the keys also. When Ananya returned from the function, she found that the car has been stolen from "City Center" mall, where it was left unattended by Saloni. Explain the liability of Saloni towards Ananya (if with the help of relevant statutory provisions and case laws? (Marks 05)
3. Answer the following:
a. Elucidate as to what distinguishes 'Pledge' from 'Mortgage', 'Hypothecation' and (Marks 04)
b. Explain, "Destruction of Surety's eventual remedy and its legal consequences". You may place reliance on the suitable provisions of the Indian Contract Act, 1872, landmark judgments and analogues pragmatic illustrations. (Marks 06)
