Mid Term Examination, September- 2016 B.A.LL.B. (HONS.) SEMESTER VII IX COMPETITION LAW Max. Marks: 20 Max. Time: 1:30 Hrs. Note: Answer any TWO questions out of three. All questions carry equal marks.
1. Walter Adams and James W. Brock mentioned in The Sherman Act and the Economic Power that: The 19th century saw the entrenchment of American laissez-faire political liberalism, which, on one hand, embraced classical economic theory with a faith in free and universal competition as upheld by Adam Smith and, on the other hand, emphasized the protection of individual rights against power, including the economic power. In the light of abovementioned paragraph discuss in detail all the major events from trust to antitrust in United States and from political independence to economic liberalization in India, which laid down the basis for competition law in both the jurisdictions. (Marks 10)
2. Write a detailed note on the following:- (Marks 5×2=10) a. Differentiate between Productive Efficiency and Dynamic Efficiency b. Different Models of Competitive Market
3. Write a detailed note on the following: (Marks 5×2=10) a. Discuss tie-in arrangement under the Competition Act, 2002 and also discuss the available justification. b. Distinguish between exclusive supply agreement and exclusive distribution agreement under the Competition Act, 2002.
