END TERM EXAMINATION, NOVEMBER 2016 B.A.LL.B. (HONS.) SEMESTER-VII IX Cr.L.- Transnational Crime and Law (Hons.-II) Max. Marks: 60 Time Allowed: 3:00 Hrs. Note: Answer five questions including Question No. 1 which is compulsory. The number of marks carried by each question is indicated at the end of the question. 1. Answer the following (each answer should be in approximately 100 words): (Marks 2×10=20) a. Distinguish between Human Smuggling and Human Trafficking. b. What do you understand by Extradition? c. Discuss the role of Interpol in controlling Transnational crime. d. Distinguish between International Crime and Transitional Crime. e. What do you understand by the term Disorganised crime? f. Briefly describe the aims and objectives of Geneva Convention. g. Write short notes on pornography as Transnational crime. h. Discuss the efforts made at international level to check the crime of sex slavery. i. Is Jihad a Religious Terrorism? Discuss in brief. j. Discuss organ trafficking as Transnational crime. 2. (a)Examine the definition of Genocide. Can it be 'genocide' where an isolated individual acts with a fervent, albeit unrealistic, intent to destroy a group? State your answer with reasons. (b)Article of the ICC Statute encompasses the imposition of measures aimed at preventing births within the group and thereby targeting biological existence. This conduct includes, for example, sterilization, forced birth control, prohibition on marriage, and segregation of the sexes. In the light of the above statement discuss with reasons why the measures taken by various heavily populated countries-such as China- to forcibly lower the birth rate does not constitute the crime of genocide. (Marks 5×2=10) 3. The issue of Narco-Terrorsim is very complicated as it comprises with two very pressing issues in our world today, i.e., the illicit drug dealing and terrorism. This is because they both find symbiotic benefits to each other. Acknowledging this fact and assessing the manner in which terrorism and illicit drug dealing function as one unit. Discuss the effective measures applied at the international level to control the narcotics industry because as long as it exists, terrorists will always look to it as a source of liquid funds to further their motives. (Marks 10) 4. Piracy poses a strong challenge to the international order and is one of the fast growing transnational crimes of the future. Discuss. (Marks 10) 5. Discuss the reason that account for unfortunate increase in transnational crimes. Discuss the role of United Nations in Internationalization and elimination of transnational crime. (Marks 10) 6. The Creation of the International Criminal Court is a milestone towards building a global criminal justice system. Unfortunately the great majority of transnational crimes is outside the jurisdiction of the International Criminal Court. However, the creation of the Court has generated the scope to strengthen the universal criminalization of transnational organized crime as the existing offences under International Criminal Court Statute, may, potentially encompass some transnational organized crimes. Discuss. (Marks 10) 7. Globalization has facilitated significant growth in transnational crime conceding this fact; discuss its influence/effect on democratic governance and threat to sovereign nations. (Marks 10)
