END TERM EXAMINATION, NOVEMBER 2016 B.A.LL.B. (HONS.) SEMESTER-VII IX T&I-International Trade Law (Hons.-II) Max. Marks: 60 Time Allowed: 3:00 Hrs. Note: Answer five questions including Question No. 1 which is compulsory. The number of marks carried by each question is indicated at the end of the question.

1. Answer the following (each answer should be in approximately 100 words): (Marks 2×10=20) a. What is ''coherence Where is it provided in the Agreement Establishing the WTO? b. What are the objectives and main functions of the WTO? c. State the functions of General Council under WTO. d. What does ''single undertaking'' mean? Also discuss the differences between GATT 1947 and GATT 1994. e. Critically analyze the theory of absolute advantage. f. What are the economic and political factors for government's intervention in market? g. Discuss in brief the theory of Mercantilism. h. Mention briefly the seven instruments of trade policy for the protection of domestic industries. i. What are the exceptions for rule of elimination of quantitative restrictions under Article XI under GATT 1994? j. Discuss the scope of the Agreement on Pre-shipment Inspection.

2. Art. I.1 of the GATT 1994 provides that: "With respect to customs duties … any advantage … granted by any Member to any product originating in or destined for any other COUNTRY shall be accorded immediately and unconditionally." In this context discuss the objectives and scope of the MFN principle along with its exceptions. (Marks 10)

3. "The WTO is not an environmental protection agency. Its competence in the field of trade and environment is limited to trade policies and to the trade-related aspects of environmental policies which have a significant effect on trade." In this background discuss the inter-linkage between trade and environment. (Marks 10)

4. What are the main objectives and scope of the National Treatment principle? Discuss the criteria to determine whether two products are "like products." (Marks 10)

5. Discuss the following: (Marks 5×2=10) a. What is meant by Rules of Origin and when are these rules used? b. What are the SPS and TBT Agreements? What are the main objectives of the two Agreements?

6. Discuss the following: (Marks 5×2=10) a. What is dumping? How is it calculated? Explain briefly the three substantive conditions to be met before the application of an anti-dumping measure. b. What is the relationship between Trade and Investment as well as Trade and Competition Policy?

7. Discuss the following: (Marks 5×2=10) a. Explain the object and purpose of the Chapeau of Article XX of the GATT 1994 and also discuss the structure of Article XX of the GATT 1994. b. Why the SCM Agreement is considered "two agreements in one"? State the categories of subsidies covered by the SCM Agreement.
