END TERM EXAMINATION, NOVEMBER 2016 B.A.LL.B. (HONS.) SEMESTER-VII Criminal Procedure Code (Cr.P.C.) Max. Marks: 60 Time Allowed: 3:00 Hrs. 1. Answer the following (each answer should be in approximately 100 words) (Marks a. Distinguish between cognizable and non-cognizable offences. b. Discuss essential conditions for granting maintenance under section 125 of the Code of Criminal Procedure. c. Under what circumstances a magistrate and a private person can arrest to an offender? d. What do you understand by the term search warrant? e. Discuss evidentiary value of statement made by an accused to the police. f. What do you mean by the term discharge? Explain content of charge in brief. g. What is difference between warrant cases and summon cases. h. Distinguish between police custody and judicial custody. i. What do you understand by anticipatory bail? j. Plea Bargaining

2. "The provision relating to maintenance given under Section 125 has secular character and applicable to all the community." In the light of judicial pronouncement discuss law relating to maintenance provided under section 125 of the Code of Criminal Procedure. (Marks10)

3. Under what circumstances a Police officer can arrest to an accused without warrant? A Police officer arrest an accused without warrant for the commission of non-cognizable offence. Discuss the legal liability of Police officer. (Marks 10)

4. What do you understand by the First Information Report Discuss with the help of judicial pronouncements. (Marks10)

5. 'Bail not Jail'. In the light of this statement discuss the circumstances in which an accused can be released on bail. (Marks10)

6. "There should be separate charges for distinct offence." Under what circumstances charges can be framed jointly? Discuss in detail. (Marks10)

7. Discuss the procedure regarding trial of warrant cases instituted on police report. A judicial magistrate first class empowered by the High Court try a case in summery way and passes sentence of Six Months. In the light of statutory provision discuss the legal significance of such judgment. (Marks 10)
