SEMESTER V
LABOUR LAW-II
Max. Marks: 20 Max. Time: 1:30 Hrs.
Note: Answer any TWO questions out of three. All questions carry equal marks.
1. "In the Indian context, Social Security is a comprehensive approach designed to prevent deprivation, assure the individual of a basic minimum income for himself and his dependents and to protect the individual from any uncertainties."
In the light of above statement explains the concept of Social Security in India.
An employee of a company has been taken for employment as retainer with effect from 01.09.2005 to 30.11.2005 which was renewed again 01.12.2005 to 28.02.2006. His terms of employment were again renewed on 01.03.2006 to 31.08.2006. Now the company gave him an appointment on contract for three years from the period 05.09.2006 to 04.09.2009 which was renewed again on 05.09.2009 for another period of three years of employment. The employee was getting benefits of Provident Fund and Employee State Insurance as per Act from the day one of his employment. He left the organization on September 2010 at the completion of five years of employment.
Explain, whether the employee will be eligible for gratuity from employer? Discuss the provisions of the relevant Act. (Marks
2. a cinema theatre was an establishment covered under ESI Act. The management leased out their parking place for scooters and canteen to two persons, A and B. The management paid contributions in respect of employees working in the theatre, but excluded the employees A and B. ESI Corporation filed a suit against for recovery of the contribution of the employees of A and B. The management contends that the employees of A and B were not their employees. Advice with your explanation.
An employee, employed as a peon in a factory was returning home after completing his working hours, on his way back home he decided to visit a temple, while he was coming out of the temple he was hit by a passing car and suffered severe injuries. Looking at the facts and circumstances of the case decide:
