SEMESTER V Labour Laws-II
Max. Marks: 20 Max. Time: 1:30 Hrs.
Note: Answer any TWO questions out of three. All questions carry equal marks.
1. "The Employees' State Insurance Act is a beneficial piece of social legislation in the interest of labour in factories at the first instance and with power to extend to other establishments." In context to the given statement explain the nature and scope of the Employees' State Insurance Act, 1948. (Marks 10)
2. It is stated that "No compensation can be granted for any physical disability unless there was a loss of earning capacity." Explain your answer in the light of the provisions of the Employees' Compensation Act, 1923. Discuss relevant case laws also. (Marks 10)
3. Mr. Santosh was an employee of Kartik Cement Company Limited. He retired from the company after completing 35 years of continuous service. He applied to the company for the payment of gratuity within the prescribed time. The company refused to pay the gratuity and contended that due to stringent financial condition the company is unable to pay the gratuity. Mr. Santosh applied to the Appropriate Authority for the recovery of the amount of gratuity. In the light of above situation, discuss the provisions of law and the decided case/s, if any. (Marks 10)
