(bl In a state, the entire road transport was run by the state, as it
was managed departmentally. But, later, under a law passed by the
State Legislature, a State Road Transport Corporation was brought
mto existence. The new corporation is asked to pay income tax. The
state claims immunity under Art. 289 of the Constitution. Decide,
giving reasons.

Ibl The State of Karnataka entered into a contract with the Union of
India to supply sandalwood products of a certain quality for a fixed
price. The contract complied with Art. 299 of the Constitution of
India. There was anticipatory breach of the contract on the part of
the Union of India. The Government of Karnataka filed a suit
under Art. 131 of the Constitution, claiming for an order of specific
performance. Decide, giving points of arguments for both parties.

Explain the rights and duties of States 1,.vith regard to aliens.
Albert, a British national, along with a hundred men madp
preparations to commit piracy on the high seas. But, the attempt
failed due to a U.S. ""'arship's entry into that area. The pirate ship
landed on Indian soil. Albert and his men are arrested and tried in
Indian courts. Albart contends that Indian courts have no
jurisdiction as they have not commlttl'd any wrong. Advise the
Indian Government.

Ramu is having his early morning walk on a public road. Kalu, showing a revolver, stops him. Ramu, for fear of his life, hands over his wrist watch, mobile phone and a gold chain to Kalu. Has Kalu committed any offence? Elucidate.
2.
Dr. Bilappa, working in a Government Hospital, performed tubectomy on Smt. Vinita, mother of two daughters of 5 years and years of age. This
was as part of a state-sponsored Family Planning Programme. After a year, Smt. Vinita gave birth to a female child. What relief can be claimed by Smt. Vinita and against whom? Decide.

John lost his cell phone in a park. Jack found it and took it home. He thought of returning it to the owner, when the owner issued an advertisement giving his name, address, etc. But, in the mean time, it was stolen from his house, at night. John wants to claim the cost from Jack. Decide, giving reasons.
4.
Vikas sold goods worth Rs. 5 lakhs to Vilas on credit of 1 month. The goods were sent through a carrier. Before the goods reached the destination, Vilas became insolvent, within a week after the sale. State the remedies available to Vikas. Can the receiver of the debtor-Vilas have any relief?

The Government of Karnataka purchased 20 Maruti Esteem cars for its new Ministers, which were refused by the Ministers. Mr. Govinda, without authority, purchased one of them, for his principal Mr. Kapoor, at the auction sale conducted for the sale of these new cars, on 10.4.2005, subject to approval by his principal. But, on 12.4.2005, the auction sales were cancelled. On 14.4.2005, Mr. Kapoor approved the purchase made by Gavinda. Explain, who has the ownership of the car.

A landlord in a village, at the request of the villagers, allowed a portion of his land to be used as a burial ground. But, he did not allow the Daliths to use it. Does this amount to any offence under the Protection of Civil Rights Act, 1955 Give reasons.
7.
A Food Inspector takes a sample of an article of food being sold by Narayan and sends it to the Public Analyst for analysis. As per the procedure, he ought to do so in the presence of one or more persons and take their signatures. But, he has taken the sample in the presence of a person working in his Department and taken his signature. The food article was adulterated. Narayan is convicted. Narayan challenges his conviction. Decide as per the Prevention of Food Adulteration Act.

Rajan agreed for the marriage of his son, Ranu with Reeta, daughter of Milind. Milind paid Rajan Rs. Two lakhs as dowry, before the wedding. The marriage did not materialise. Mihnd demanded the return of the Rs. two lakhs. Rajan refused. Can Milind sue for recovery, in a court of law? Decide as per the Indian Contract Act and the Dowry Prohibition Act.

Thomas, the employer of Joseph, presents a cheque of Rs. 25,000 to Joseph on the occasion of Joseph's marriage. This is given because Joseph has been very useful to Thomas in his business. Shortly thereafter, Joseph leaves the employment. The cheque is dishonoured by the Bank. Advise as to the liability of Thomas and the rights of Joseph, as per the Negotiable Instruments Act.
10.
Munna, aged years, is admitted to benefits of a partnership firm,
B of which Abraham and Balu are partners. Munna holds himself out as a partner and enters into a contract, on behalf of the firm, to purchase goods worth Rs. One lakh. The firm disowns the contract, saying Munna is a minor and is not the agent of the firm. Decide, with reference to the Indian Partnership Act.

Dr. Bilappa, working in a Government Hospital, performed tubectomy on Smt. Vinita, mother of two daughters of 5 years and years of age. This
was as part of a state-sponsored Family Planning Programme. After a year, Smt. Vinita gave birth to a female child. What relief can be claimed by Smt. Vinita and against whom? Decide.

John lost his cell phone in a park. Jack found it and took it home. He thought of returning it to the owner, when the owner issued an advertisement giving his name, address, etc. But, in the mean time, it was stolen from his house, at night. John wants to claim the cost from Jack. Decide, giving reasons.

Vikas sold goods worth Rs. 5 lakhs to Vilas on credit of 1 month. The goods were sent through a carrier. Before the goods reached the destination, Vilas became insolvent, within a week after the sale. State the remedies available to Vikas. Can the receiver of the debtor-Vilas have any relief?

The Government of Karnataka purchased 20 Maruti Esteem cars for its new Ministers, which were refused by the Ministers. Mr. Govinda, without authority, purchased one of them, for his principal Mr. Kapoor, at the auction sale conducted for the sale of these new cars, on 10.4.2005, subject to approval by his principal. But, on 12.4.2005, the auction sales were cancelled. On 14.4.2005, Mr. Kapoor approved the purchase made by Gavinda. Explain, who has the ownership of the car.

A landlord in a village, at the request of the villagers, allowed a portion of his land to be used as a burial ground. But, he did not allow the Daliths to use it. Does this amount to any offence under the Protection of Civil Rights Act, 1955 Give reasons.

A Food Inspector takes a sample of an article of food being sold by Narayan and sends it to the Public Analyst for analysis. As per the procedure, he ought to do so in the presence of one or more persons and take their signatures. But, he has taken the sample in the presence of a person working in his Department and taken his signature. The food article was adulterated. Narayan is convicted. Narayan challenges his conviction. Decide as per the Prevention of Food Adulteration Act.

Rajan agreed for the marriage of his son, Ranu with Reeta, daughter of Milind. Milind paid Rajan Rs. Two lakhs as dowry, before the wedding. The marriage did not materialise. Mihnd demanded the return of the Rs. two lakhs. Rajan refused. Can Milind sue for recovery, in a court of law? Decide as per the Indian Contract Act and the Dowry Prohibition Act.

Thomas, the employer of Joseph, presents a cheque of Rs. 25,000 to Joseph on the occasion of Joseph's marriage. This is given because Joseph has been very useful to Thomas in his business. Shortly thereafter, Joseph leaves the employment. The cheque is dishonoured by the Bank. Advise as to the liability of Thomas and the rights of Joseph, as per the Negotiable Instruments Act.
10.
Munna, aged years, is admitted to benefits of a partnership firm,
B of which Abraham and Balu are partners. Munna holds himself out as a partner and enters into a contract, on behalf of the firm, to purchase goods worth Rs. One lakh. The firm disowns the contract, saying Munna is a minor and is not the agent of the firm. Decide, with reference to the Indian Partnership Act.
