Max. Marks: 60 Time Allowed: 3:00 Hrs.
Note: Answer five questions including Question No. 1 which is compulsory. The number of marks
carried by each question is indicated at the end of the question.
1. Answer the following (each answer should be in approximately 100 words): (Marks 2×10=20)
a. Strict liability
b. Good faith
c. Accident
d. Infancy
e. Liability of abettor when one act abetted and different act done
f. Riot
g. Grievous hurt
h. Mischief
i. Criminal conspiracy
j. Abettor
2. Discuss the liability of in following situationsa.
A and his friend go to dance bar. There they get into a sudden fight with another group
of persons over a dance. During the fight, A grabs a beer bottle and hits it on the head
of another person. That person suffers head injuries and dies in the hospital.
b. A and B two hooligans come across each other and have an argument. A punches B in
stomach. B had an inflamed ulcer in his stomach which ruptures due to the punch and
cause internal bleeding. He succumbs in the hospital and dies. (Marks
3. A is a door-to-door salesperson. One day, A went to a house in the course of her daily sales
rounds, and found that a six-year-old child, was alone at home. A offered B a chocolate,
and told her that she would take B to an amusement park for the day. B believed and A
took B out of the house. Later, A is prosecuted for kidnapping. Is A guilty or not? Justify your
answer in the light of decided case law and write the difference between kidnapping and
abduction. (Marks 10)
4. and E gather together in an empty shed for stealing from Sheila's house. B and D
bring weapons such as a knife, hockey Stick, etc. however, at the last moment D and E
get scared and go back to home. A alone enters the house of Sheila and takes the painting. The
watchman sees him taking it and tries to stop him. A punches him and runs away with the
painting.
a. What offence is A guilty of? Justify your answer
b. Are A B C D and E guilty of any offence? Give reason. (Marks 5x2=10)
5. Discuss the differences between:
a. Murder and culpable homicide.
b. Misappropriation of property and criminal breach of trust. (Marks 5x2=10)
6. Define Theft. When does theft become Robbery and how it is different from Extortion? Give
suitable illustration and decided case law. (Marks 10)
7. a. What is Private Defence? When does the right of private defence of the body extend to
cause death?
