INTELLECTUAL PROPERTY RIGHTS
Max. Marks: 20 Max. Time: 1:30 Hrs.
Note: Answer any TWO questions out of three. All questions carry equal marks.
1. "The present regime of IPR is not the creation of one day" in the light of this statement discuss the historical development of Intellectual Property Rights at the international level. (10 marks)
2. X was an architect by profession and a play writer, dramatist and producer as well. He wrote and produced a play, which received huge success and was re-staged numerous times. With the increasing popularity, Y got in touch with X. During the X meeting with X narrated the entire play to X had elaborate discussions regarding filming the play. However, there was no further communication between X and Y after that discussion. Y commenced the making of the film, which X believed to be based on his play. Nevertheless, Y guaranteed him that the movie had no resemblance and was not remotely related to his play. But after watching the movie, X came to the conclusion that the movie was indeed a copy of his play and consequently filed a suit for permanent injunction seeking a restraint against the Y for infringement of his Copyright in the play, now on the basis of this fact answer the following (Marks
