SEMESTER III Law of Torts
Max. Marks: 20 Max. Time: 1:30 Hrs.
Note: Answer any TWO questions out of three. All questions carry equal marks.
1. "Tortious liability arises from the breach of a duty primarily fixed by the law; this duty is towards
persons generally and its breach is redressible by an action for unliquidated damages."
In the light of above discuss the nature, scope and essentials of torts. (Marks 10)
2. Contemplate on the maxim 'volenti non fit injuria' with its exceptions. (Marks 06)
Mr. Ram leaves a bullock cart unattended in a street. A child of seven years of age while
playing in the street throws a stick towards the cart. Due to the same the cart starts running causing
grave danger to one woman and some children in the street. Mr. Shyam, a passerby, on seeing the
same manages to stop the bullock cart, but in doing so he himself suffers serious personal injuries.
Can the owner of the bullock cart be made liable for the injury of Mr. Shyam? (Marks 04)
3. Write short notes on any two: (Marks 5×2=10)
