1. What do you understand by the term "tort"? And also mention its essential elements.

Mr. Ram runs a coaching centre for law students near Pandri, Raipur, Chhattisgarh. Suddenly Mr. Shyam hires a building and starts his coaching centre for law students in front of Ram's coaching centre in the same place. As a consequence thereof, due to cut throat competition of two coaching centers, Mr. Ram is to reduce the course fee of law coaching substantially and faces monetary loss thereby.
You are hereby asked to advice Mr. Ram whether he will succeed in claiming compensation under law of tort or not. (Marks 05)
2. Discuss the concept of volenti non fit injuria with exceptions. (Marks 05)
Due to recent natural disaster in Kerala state, the flower garden of Mr. Nair was damaged substantially owing to the flow of water coming from Mr. Pillai's land. Can Mr. Nair claim compensation from Mr. Pillai for the loss suffered by him? (Marks 05)
