Mid Term Examination, September- 2016 B.A.LL.B. (HONS.) SEMESTER III Family Law-II Max. Marks: 20 Max. Time: 1:30 Hrs. Note: Answer any TWO questions out of three. All questions carry equal marks.
1. What do you mean by Adoption? What are the requisites of a valid adoption under the Hindu Adoptions and Maintenance Act, 1956? (Marks 10)
2. "Ordinarily neither the Karta nor other coparcener, singly possess the power of alienation." Compare a Karta's power of alienation with that of a sole surviving coparcener. (Marks 10)
3. Write short notes on the following:- (Marks 5×2=10) a. Differentiate between a Mitakshara and Dayabhaga Coparcenary b. Three brothers maintaining a Joint Family status and forming a coparcenary together inherited a separate property belonging to their paternal great-grandmother. On the death of one of the brothers, his second widow claimed a portion of the property belonging to the deceased husband. Explain with the help of relevant case laws whether the widow will succeed in claiming this property with special reference to the nature of such property.
