Drafting, Pleading and Conveyancing
Max. Marks: 60 Time Allowed: 3:00 Hrs.
Note: Answer five questions including Question No. 1 which is compulsory. The number of marks
carried by each question is indicated at the end of the question.
1. Answer the following (each answer should be in approximately 100 words): (Marks 2×10=20)
a. 'Drafting and 'Conveyancing' are inter-changeable terms.
b. Necessary Parties and Proper Parties.
c. Joinder, Non joinder and Misjoinder.
d. Constructive Admission.
e. Evasive Denial.
f. Temporary Injunction.
g. Difference between Appeal and Memorandum of Appeal.
h. Anticipatory Bail.
i. Mortgage.
j. Distinction between Lease and Licence.
2. Discuss the main objective of pleading. Explain the fundamental rules of pleading in civil suit.

3. was working in the revenue department and he was dismissed from his service without
giving him reasonable opportunity of hearing. Draw a plaint on his behalf for wrongful
dismissal and damage. (Marks 10)
4. Draft a criminal complaint regarding defamation on behalf of a businessman Mr. Aman
Kumar against another businessman Mr. Punit Kumar carrying out the same business in the
same industry. (Marks 10)
5. Draft a bail application on behalf of the accused in the case of section 307, Indian Penal Code.
The other co-accused has already been released on bail by the court. (Marks 10)
6. wishes to gift his movable and immovable properties to his daughter on her marriage.
Draft a gift-deed on behalf of in favour of (Marks 10)
7. Dhani Ram has agreed to sale his house to Basant Singh for Rs. 5 lakhs, Dhani Ram has paid
Rs. One lakh as earnest money. The sale is to be completed within two months from the date
of agreement. Draft an agreement to sale the said house. (Marks 10)
