Max. Marks: 60 Time Allowed: 3:00 Hrs.
Note: Answer five questions including Question No. 1 which is compulsory. The marks carried by each
question are indicated at the end of the question.
1. Answer the following (each answer should be in approximately 100 words): (Marks 2×10=20)
a. Write a comment on 'after care services' in India.
b. When omissions amount to contradiction?
c. What are the Conditions for admissibility of expert evidence?
d. "Anticipatory bail is misnomer" explain.
e. Enumerate rights of victim under Cr P.C.
f. Can judicial officer go for investigation? Explain with law.
g. Discuss the pecuniary jurisdiction of criminal court in India.
h. Explain the inquisitorial system.
i. What is the evidentiary value of confessional FIR?
j. Explain the various type of plea bargain.
2. What do you mean by the term information? When information can be termed as first
information report? What is the effect of delay in lodging the FIR? Whether telephonic
message amount to FIR? Discuss in detail with the help of relevant statutory provision and
decided case laws. (Marks 10)
3. What do you mean by the term 'non cognizable offence'? Whether an FIR can be made in
case of non cognizable offence? Discuss in detail the procedure of investigation in case of non
cognizable offence by police officer under Cr.P.C. 1973 with suitable provision and decided
cases. (Marks 10) 4. When information is given, it is the duty of the police officer to proceed forthwith for the
investigation of the offence but sometime police may defer investigation or decide not to
investigate the case. Elucidate with the help of suitable provision of Cr. P.C.
Discuss the protection given to minor male and women under the Cr.P.C. 1973 while the
investigation is going on (from section 157 to section 173 of Cr.P.C. 1973). (Marks
5. What is the use of statement made to police during the course of investigation from the
perspective of admissibility and inadmissibility of the evidence? Discuss in detail. (Marks 10)
6. "When the prison gets slum behind an inmate, it does not lose his human quality; his mind
does not become close to ideas, his intellect does not cease to feed on a free and open
interchange of opinions, his yearning for self-respect does not end; nor is his quest for self
realization concluded" Justice Thurgood Marshall.
In the light of above statement, discuss the law relating to institutional correction in India.

7. "All the admissible evidence is relevant but vice versa is not true." In the light of this
statement discuss the difference between relevancy of fact and admissibility of evidence with
suitable example and case laws.
"Clients should be encouraged to be completely truthful with their attorneys, so that the
attorney's legal advice can be based on all relevant facts and more than this, the clients will be
reluctant to seek an attorney's advice if they fear that their communications will be revealed to
others, for achieving this end their communication is protected by law but in Indian context
this privilege is not confined to only attorney and client relationship". Discuss in detail with
