SEMESTER-VIII X CG-Compensatory Discrimination (Hons.-II)
Max. Marks: 60 Time Allowed: 3:00 Hrs.
Note: Answer five questions including Question No. 1 which is compulsory. The number of marks
carried by each question is indicated at the end of the question.
1. Answer the following (each answer should be in approximately 100 words): (Marks 2×10=20)
a. Meaning of 'civil rights' under the Protection of Civil Rights Act, 1955
b. Distinction in 'place of birth' and 'residence' as a ground for discrimination
c. Fundamental duty towards women
d. Presumption of Dowry death
e. Object of special provisions relating to certain states under Indian Constitution
f. Minister in charge of Tribal Welfare
g. Distinction in 'varna vyavastha' and 'caste system'
h. Negative and positive aspects of discrimination
i. John Rawls views on discrimination
j. Effect of conversion on the right for special treatment.
2. "The equal protection of laws does not mean that all laws must be general in character and should
apply to all persons because varying needs of different classes of persons often require separate
treatment." In this context discuss that reasonable classification is necessary if society is to
progress. (Marks 10)
3. Answer the following:-
a. A woman belonging to scheduled caste category marries a man of general category. Discuss
whether the woman and the children born out of this marriage will get the benefits of
reservation in admission, employment and elections.
b. What is the effect on the rights, privileges and benefits enjoyed by a person belonging to
scheduled caste or scheduled tribe in the state of his origin if he subsequently migrates to
another state? (Marks
4. Answer the following:
a. How far do you agree that the admission to highest available medical and engineering courses
in the country at the super speciality level must be given only on the basis of competitive
merit?
b. Whether the criteria of minimum qualifying marks for selection of candidates for admission
may subsequently be relaxed for candidates belonging to SC and ST categories who fail to
acquire such minimum qualifying marks in entrance test? (Marks
5. Discuss the following:
a. Impact of the concept of creamy layer for the exclusion of advanced sections from other
backward classes and the desirability of this concept to apply to SCs and STs.
b. Attitude of legislature and the approach of the judiciary regarding the reservation in promotions
in seniority. (Marks
6. Answer the following:
a. Make a critical evaluation that Article 330 to Article 342 of the Indian Constitution have been
sufficient to safeguard the political interest of SCs, STs and backward classes.
b. Discuss the powers and functions of National Commission for Scheduled Caste. Also discuss
the role of the Commission in doing social justice and to protect the Scheduled Caste from
discrimination. (Marks
7. "Discrimination against women violates the principle of equality of rights and respect for human
dignity." In the light of given statement discuss the special provisions measures taken by the
legislature through different legislations and gender sensitivity of judiciary in judicial
pronouncements for protection of women. (Marks 10)
