B.A. LL.B. (Honours)
Semester VII IX Cyber Law (Optional-1)
Max. Marks: 20 Max. Time: 1:30 Hrs.
Note: Answer any TWO questions out of three.
The number of marks carried by each question is indicated at the end of the question. 1. In the digital age, privacy has become an intensely discussed and debated topic. The right to privacy and data protection regime in India was in a state of flux; however, the year of 2017 has been a humdinger of a year for data privacy laws. In the light of above statement discuss the status of right to privacy in India, highlighting relevant provisions, rules under Information Technology Act, 2000 and landmark cases if any. (Marks 10) 2. Answer the following:
a. Define and distinguish between Digital Signature and Electronic Signature. Also, explain in detail the procedure of obtaining Digital Signature Certificate from Certifying Authorities as mentioned under the Information Technology Act, 2000. (Marks 05)
b. What do you mean by Right of Interception as mentioned under the Information Technology Act, 2000? Discuss the circumstances in which it can be exercised highlighting the relevant sections, rules provided under the Information Technology Act, 2000. (Marks 05)
3. Answer the following:
a. UNICITRAL has adopted the Model law on E-Commerce which proved to be significant for enactment of the IT Act, 2000. Discuss its importance highlighting key provisions. (Marks 05)
b. Mr. XYZ has been repeatedly following, monitoring activities of Ms. ABC through various social websites and apps. Later on, Mr. XYZ sent some obscene messages to Ms. ABC, including demand for sexual favours. Ms. ABC strongly rejected the demand and warned Mr. XYZ not to send any messages again. Mr. XYZ did not stop here, he blackmailed Ms. ABC by saying that if she fails to fulfill the demands then he will publish, transmit the nude images of Ms. ABC on social websites, which he had captured earlier without her knowledge. Ms. ABC did not respond at all believing this to be false.
After few days Ms. ABC got to know from her friends that her nude images have been uploaded by some person on various social sites mentioning her name, contact no and some filthy language was used against her. Accordingly FIR was filed and Mr. XYZ was arrested.
Decide the liability of Mr. XYZ mentioning different sections/provisions of relevant Legislations. (Marks 05)
