2. A factory was insured against fire. It was lost in fire, but the insurance company repudiated all claims under the policy. The policy provided that if any dispute arose as to amount of loss or damages the same would be decided by arbitration. The insurer filed a suit in a court of law. Whether this is proper in view of section 8 of the Arbitration and Conciliation Act, 1996? Decide (Marks 10)
