SEMESTER VIII X
T&I-International Commercial Law (Hons.-II)
Max. Marks: 20 Max. Time: 1:30 Hrs.
Note: Answer any TWO questions out of three. All questions carry equal marks.
1. What are the mandatory legal principles that are fundamental to the contract formation and interpretation given as the hierarchy of norms by J H Dalhuisen? (Marks 10)
2. Mr. N form Country X regularly sales the noodles from last several years to Buyer B from country I distributed through its office in country where both the parties are from contracting parties to CISG. After sale of noodles for several years the law of Country I declared the goods not in conformity of food safety standards of that country and thus banned the sale. Buyer sues the seller for not delivering the noodles in conformity with the domestic laws of that country. The seller takes the defense that the buyer had not informed the seller regarding the safety standards of his country neither such requirement was expressly agreed between the parties the noodles were in conformity with the basic minimum standards required for sale of food items and also were in conformity with the sellers country and most other countries' laws where they are sold. With the help reference to appropriate case law decide who shall be liable for the conformity of goods. Also, list out the remedies available to the buyer for delivery of goods not in conformity.
