Max. Marks: 60 Time Allowed: 3:00 Hrs.
Note: Answer five questions including Question No. 1 which is compulsory. The number of marks
carried by each question is indicated at the end of the question.
1. Answer the following (each answer should be in approximately 100 words): (Marks 2×10=20)
a. Can a law graduate be enrolled as an advocate before more than one State Bar Council?
b. Who prepares and maintains the common roll of advocates and how it is done?
c. What is right to Pre-Audience?
d. Whether innocent publication may be accepted as defense in contempt cases?
e. Whether drafting of Plaint or Written Statements comes under the term Practice of
Profession?
f. Is it correct to say that legal profession is an independent profession?
g. What actions may be taken against any advocate in case of violation of rules of conduct?
h. Whether advertisement by advocates comes under the definition of misconduct?
i. Whether in case of nonpayment of fee, advocates have lien over the documents of their
clients?
j. In which condition any foreign national may be enrolled as an advocate in India?
2. Discuss and critically examine the historical development of legal profession in India.

3. "Advocates should not be guided by profit motive because advocacy is a pro-bono-publico
service." Do you agree with this statement? Discuss the essential nature of legal profession.

4. What is Professional Misconduct? Explain the procedure for punishment under the Advocates
Act, 1961 (Marks 10)
5. Discuss the constitution, power and functions of the Bar Council of India under the Advocates
Act, 1961. (Marks 10)
6. "The Constitutional freedom of speech and expression is not absolute". Examine this
statement in the light of the Contempt of Courts Act, 1971. Your answer should be supported
with relevant case laws. (Marks 10)
7. Write Short notes on any Two of the followings: (Marks 5×2= 10)
d. Strike and boycott activities by lawyers
e. Services of advocates and the Consumer Protection Act, 1986.
f. Entry of foreign law firms and legal outsourcing in India.
