Note: Answer five questions including Question No. 1 which is compulsory. The number of marks
carried by each question is indicated at the end of the question.
1. Answer the following (each answer should be in approximately 100 words): (Marks 2×10=20)
a. Rule of law and rule according to law.
b. Factors which led to the appointment of Donoughmore committee in England.
c. State of affairs which compelled the appointment of Frank's committee.
d. Conceald'etat.
e. Doctrine of self restraint.
f. Delegation of power to impose the taxes
g. Doctrine of pleasure
h. Delegatus non potest delegare.
i. Procedure of appointment of Chief Information Commissioner and Central Information
Commissioner in CIC.
j. Meaning of Right to Information under section 2 of the RTI Act 2005.
2. "Administrative law is the study of pathology of governmental power." Discuss this
formulation against the backdrop of the grant and exercise of public power in authoritarian
liberal and non-liberal societies. (Marks 10)
3. Answer the following:-
a. What principle other than the principle of sovereign and non sovereign functions can be
suggested to bring equilibrium between governmental accountability and individual
justice?
b. Distinguishing between rules and directions. Discuss the law relating to enforceability of
Administrative directions. (Marks
4. Administrative decision making is a byproduct of intensive form of government and
consequential socialization of law and it is also correct to say that the strategy of
Administrative adjudication was developed not as a result of public necessity but for
governmental convenience and expediency. In this context discuss the need and parameters of
administrative adjudication. (Marks 10)
5. Answer the following:-
a. Identify the legal basis in the absence of legislative silence on the ground of which legal
representation and cross examination may be mandatory procedural requirement for
administrative authorities in exercising adjudicatory powers.
b. Discuss the distinction in approach of court in applying the tests of 'reasonable suspicion
of bias' and the 'real likelihood of bias' in the cases of bias. (Marks
