Cr.L. (Hons.-II) Criminal Justice System

Note: Answer any TWO questions out of three.
The number of marks carried by each question is indicated at the end of the question.
1. Discuss the basis of 'mens rea' under Indian criminal justice system. Also discuss the approach of Supreme Court towards applicability of 'mens rea' while interpreting penal statute in India with the help of decided cases and relevant laws. (Marks 10)
2. When 'mens rea' is not essential in substantive offence, can it be necessary in the abetment of thereof? Also discuss the concept of 'vicarious liability' under Indian criminal justice system with suitable illustrations and case laws. (Marks 10)
3. Write short notes on any two of the following: (Marks 5×2=10)
Meaning of the term under article 21 of Indian Constitution, in the context of human rights of prisoners.
Discuss the concept of 'right to speedy trial' keeping in mind the two famous maxim "justice delayed, justice denied" and "justice hurried, justice worried".
"Every violation of right against Self incrimination is the violation of right against torture". Elucidates.
