CG (Hons.-I) Fundamental Rights Its Enforcement

Note: Answer any TWO questions out of three.

1. "Part III of the Constitution is the soul of the Constitution. It is not only a charter of the rights that are available to the Indian Citizens, but is even completely in consonance with the basic norms of human rights, recognized and accepted over the world". In the light of given statement explain the importance of fundamental right and also explain how fundamental are the fundamental rights. (Marks 10)
2. Critically examine the concept of State as defined in Article 12 of the Indian Constitution. Do you think that Supreme Court, with a view to bringing under the discipline of fundamental right has widened the net of expression "other authorities" to cover bodies and institutions irrespective of the fact that they are created by statute or under a statute? Discuss with the help of important cases. (Marks 10)
3. Answer the following: (Marks 5×2=10)
a. Whether Constitutional amendment is under article
b. Whether personal laws are under Article
